And presumably none of them apply at all unless the seller brought them to your attention and you were reasonably able to read and agree to them before you purchased the software.

In virtually every other situation where you were agreeing to something of any substantial nature then you would be required to sign or initial something to prove you were aware of it, even for things that cost a lot less than the license to use XP (and etc.).
