OPatch version is independent from Oracle version, and it's platform-independent. For all pre-10.2 installations you need to use the latest OPatch release available as patch #2617419 (1.0.0.0.55 as of now, though the description says 10.1.0.2.0) For 10.2 there is a separate OPatch release (not sure if there are any plans to merge the two.)
