One wonders why we have to have these conversations on a regular basis when the legal documents are clear.
For the base SW which includes GRID control you are always pointed to the OTN page even if you purchased SW.
If you use the OTN page then you have to say yes to the OTN license agreement.
You must accept the <javascript:showAgreement();> OTN License Agreement to download this software.
Accept License Agreement | Decline License Agreement
If you click decline you are not allowed to download SW.

You can only use it for “developing, testing, prototyping, and demonstrating “ you cannot use it for “for any data processing, business, commercial, or production purposes, and not for any other purpose “.
It doesn’t matter whether the SW is free in the end or not, you are not allowed to use it for real every day purposes. This is what you legally agreed to be bound by.
Only by having a SW Purchase agreement and/or Support agreement are you allowed to use the software for those restricted activities listed in the OTN agreement.
“…If You want to use the Programs or Your application for any purpose other than as expressly permitted under this Agreement, You must obtain from Oracle or an Oracle reseller a valid Programs license under a separate agreement permitting such use. …”

As an Oracle Linux Support customer, how do I obtain Oracle Clusterware?
For 11gR2 and 12c, the wording changed which is where I think you are getting confused Mladen, but you still have to get to download it by agreeing to the OTN License policy which limits your use meaning free does not mean free for anything you can think of doing with the SW.

Oracle Clusterware may be used to protect any application (restarting or failing over the application in the event of a failure) on any server, free of charge. Of course support requires a licensed product. We weren't talking about support. We were talking about the clusterware. And clusterware is free. Thanks for finding more quotes confirming my claim.
