Satar & folks,

For public employees, the situation is a bit more complicated because of union contracts. some technical staff are exempt, others are non-exempt.

They made a giant stink about this nonsense a couple of years ago here, then after all the usual dumb meetings, most people just ignored it like 99% of the stupid policies that the govt. & lawyers come up with. I was actually told that I (as an "non-exempt") could be "written up" (have a negative report entered into my personnel file) for staying late to do off-hours sys admn work without "getting written permission"!!! what a bunch of amazingly stupid cr*pola.

(for those not in-the-know, "exempt" means you get screwed if management asks you to work overtime because you are "exempt" from getting overtime compensation. this is supposedly offset by higher status/salary. most "exempt" are people at the high-end of their job classification series, "supervisory", and so forth.)

anyway, for non-exempt, you don't have to be "paid by the hour" to get overtime pay (or comp time), you also get it if you are "salaried". all that is required is that you go over 40 hours.

If anyone wants more background & precise definitions, I know a couple of lawyers/lobbyists that work in/around the capitol here in sacramento that I can ask. I can also see what the union people have to say.
