You really need to contact a lawyer on this question. Any answer you receive here will be non-authoritative. In addition, there are many Oracle employees on the list whose answer will be constrained by their official company line.

 To you oracle employees - Im not intending this as an insult, I'm just pointing out we cannot expect an answer outside of the official company line from someone whose livelihood depends on Oracle.
