Actually, five instances of planes too close http://catless.ncl.ac.uk/Risks/23.53.html#subj1 and at least two that required pilots take evasive maneuvers, both involving business jets v. commercial jets. Would have been much worse if the weather didn't cooperate.

No. He who who is responsible. Insurance companies through operators. He who makes the rules.
Of course if you are Ronald Reagan, you just fire anyone who complains. (He fired all the air traffic controllers circa 1980, for going on strike. Over the succeeding several years, a number of newbies screwed up on the job).
