Personal Edition 9i comes with Spatial enabled and fully (& legally) available.

Oracle provides a free download at http://otn.oracle.com (look for the Downloads button at the top). Please read the license you will acknowledge (it's neither long nor complicated) to understand the terms of use.

Oracle separates the 'software' from the 'right to use the software'. The former is free, the latter requires licensing and may require payment, depending how you/they interpret the license. Software patches, on the other hand, are available only through Metalink by [paid] subscription.
