No, that could not be a problem for the restore. In an ideal world the listener would also have been shut, however these files are used for listener troubleshooting only.

Tell your colleague he shouldn't trust that backup. Maybe Legato can backup open files, but they will definitely change during backup. If he doesn't use any commands to bring the database in online backup, he may only hope that system will not crash.
