Please correct me if I am incorrect but I don't believe that is the case. Last time I checked the failover server only had to be licensed if it was open and actively applying logs and even then only after 9 days of continuous use in a calendar year.

Depending on the SLA, and how long it would take to apply the logs one could have a failover site with the operating system up, Oracle mounted exclusive but not open, and then open, apply the logs, and then restart before end-user connections and the clock starts ticking.

Whether that would work is more a question of how long one can afford to be down before violating their SLA.

Again, if my understanding is incorrect, I'd appreciate clarification.
