Given your general demeanor, I probably wouldn't discuss them with you either.

from my version of perldoc DBI:

COPYRIGHT

       The DBI module is Copyright (c) 1994-2003 Tim Bunce. Ireland.  All
       rights reserved.

       You may distribute under the terms of either the GNU General Public
       License or the Artistic License, as specified in the Perl README
       file.

I don't know if the GGPL or the artistic license qualify as open source or not.

From my version of DBD::Oracle:

COPYRIGHT

       The DBD::Oracle module is Copyright (c) 1994-2004 Tim Bunce.
       Ireland.

       The DBD::Oracle module is free software; you can redistribute it
       and/or modify it under the same terms as Perl itself with the
       exception that it cannot be placed on a CD-ROM or similar media for
       commercial distri- bution without the prior approval of the author
       unless the CD-ROM is primarily a copy of the majority of the CPAN
       archive.

IANAL, but it sounds like Mr. Bear can fix the array insert interface and distribute his fix as long as he does not do it commercially. If he were to sell code which requires his fixed module, but gave the module itself away for free through a mechanism not tied to the same CD as the commercial code, I would (again IANAL) expect that to pass muster.
