One way to look at availability of the Oracle tech software:
The [baseline of each release of the] software is free for the asking. No time bombs, no functionality locks, no hesitation. Download, or even purchase the equivalent of download using the CD-based 'tech tracks'.
The right to use that software is governed by the license. Oracle has 3 main licenses: developer, trial and 'production'. You only pay for the 'production', but you are expected to read and operate by the license you choose - including NOT putting something into production (or test or supported dev) without a 'production' license.
Patches, knowledgebase, support and ability to order official software on CD are only available with proof of trial and 'production' license.
The above does not hold true of the Applications software (at this time) as Oracle provides neither development nor trial of that.
