Actually the answer is "it depends". Read your license. If you are not using it in production (and I forget what the exact definition is - I don't have a license handy) you can contiue to use it.

If you are a member of OTN (http://technet.oracle.com/) spells it out as to what you can and cannot do with the software. If you are using it to make money - Oracle wants their cut.
