In Germany you might have a chance against Microsoft. There is a "Unlauterer Wettbewerb" act, which enforces some restrictions on waht you may do and what you may not do in advertising.

You might state that the existance and appearance of the server, along with its claim to be Microsoft Web Server, is a way of advertising this product. It is not allowed to tell a deliberate lie in an advertisment, and what else is it if you say it's MS but it isn't and you know it isn't?
