Check out - $ORACLE_HOME/rdbms/admin/catawrtb.sql -- The developers have documented this in great clarity :) - the fact that the partition check is disabled!

The Diagnostic Pack in EE and the Partitioning Option in EE are separate.
So, if you have the Diagnostic Pack, you can use AWR. Nevertheless, without the Partitioning Option, you cannot create your own Partitioned tables, but, in theory, can live with AWR's Partitioned Tables (until some bean-counter from Licence Management takes the licence documentation literally and doesn't accept your explanation of an "internal event")
One more way for Oracle to "catch" you off-guard. However, I hope that Gaja can point us to documentation which clarifies that AWR's Partitioned Tables are exempt from licensing requirements.
We had a similar discussion earlier about the Diagnostic+Tuning parameter being enabled by default in 11g

But if you're only licensed for Standard Edition, then you can't (legally) use AWR anyway since you can't license the Diagnostics Pack with SE, right, or did they change that?

It is also useful to note that EVEN if you are only licensed for Oracle Standard Edition (where database partitioning is not included), the relevant AWR tables and indexes are in fact partitioned. The script that creates the relevant WRH$ tables, sets an event for the session that is creating the tables/indexes to "disable the partition check". This enables the creation of partitioned tables/indexes for AWR.
