When we first purchased Oracle (rdbms and Forms) back in 1992 - 1994 time frame we had to buy development licenses so as far as I know whenever you were developing for production you needed a license. It was not till later that you could get a copy of Oracle without a license provided you restricted its use to certain activities, but once whatever you developed went to production or you started supporting production on the database you needed to obtain a license.
