I think you might be talking about the DBA_FEATURE_USAGE_STATISTICS view.

I was at RMOUG also. The views are present, but to use them, you still must buy the license through the diagnostic pack (even if you do not use OEM). Not sure how they can enforce anything here, just looking for everyone to blindly comply and write the checks.  

There is an internal view/table that is used to track if the ASH stuff has been used.

An Oracle rep can see if you are using the views, if he can log on to your database.

No, I cannot remember the name of the table. :(
