This 10 day grace only applies to Clusters/Failovers not Standbys. So unless your DR is in a Global Cluster you can't apply the 10 days grace.

As for a Hot standby DR site where the server is larger than the Primary server, I would think it reasonable to pay for the size of the Primary. But knowing Oracle, they might want you to pay for the 12 CPU model.
