I had a similar conversation with my Oracle rep.

The conclusions were:

if you have a database running on a machine, even if it is a standby database that no one logs into, you need a license for that machine.

You can, however, install the Oracle binaries on a backup server, and not have to pay an additional license fee, if you do not have any databases open in any form on that machine
