Oracle University now provides pdfs or e-books which are not for sale. They have your name water marked on them

They now do that because many violates the terms of use of their book and resell them.

You have something like that in your book:
Quote:
No part of this work may be reproduced or transmitted in any form or by any means, electronic or mechanical, including photocopying, recording, or by any information storage or retireval system, without the prior written permission of the copyrighted owner and the publisher.


You cannot transmit them and so even less sell them.

Transmit is not the same as transfer.
IANAL, but the text you quote does not prohibit selling of the said item.

Do you mean that "transmit" is one to many and "transfer" is one to one? My english is not good enough.

Hm, non-native speaker here too, so not sure if we are the proper persons to discuss this Smile
I associate transmit with audio/video. Air the contents so others can receive. This means (and I think that this is important) that the physical object stays with the original holder.
Selling however would transfer the object to the new holder.

Well as a native English speaker I agree with Frank.
If you're not allowed to sell it there will be an explicit clause saying so. The quoted clause just tells you you can't make copies of the CD or any of the information on the CD.
That said I'm sure there is another clause somewhere saying that you can't sell it.

Just a clarification as i see many moderators getting hyper when someone is selling stuff.

You cannot recreate : as in photocopy, scan images, record on tape the printed material.
You cannot transmit a CD/DVD : as in copy to another CD/DVD, create image, use on multiple systems that do not belong to the owner.
You cannot create a printed material/electronic object using direct or quoted inputs from the original material.
Books/Electronic material purchased in some countries is not for sale in other countries. (For example, books manufactured in India cannot be sold outside India)

If you do sell a book, you are not permitted to keep any record or copy from that book. But i guess you are not authorised to re-sell a used CD.

The thing is that books that are used in courses are not always subject to the same restrictions as regular books. If something is written specifically for the purpose of using it as course material it might be forbidden to sell it.
